1. Acceptance of Terms

By accessing or using Oxglow Analytics services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

Oxglow Analytics provides data analytics, research assistance, and related academic services to students, researchers, and professionals.

3. Academic Integrity and Proper Use

IMPORTANT NOTICE: All materials, research assistance, and deliverables provided by Oxglow Analytics are intended for reference, research assistance, and educational purposes only.

• Our services are designed to help you understand your subject matter and improve your research skills
• You are solely responsible for how you use our materials
• Direct submission of our work as your own may violate your institution's academic integrity policies
• You must properly cite and reference any materials used from our services according to your institution's guidelines
• We do not condone or support academic dishonesty, plagiarism, or any form of academic misconduct
• It is your responsibility to ensure your use of our services complies with your institution's policies and all applicable laws

4. User Responsibilities

• You must provide accurate and complete information when using our services
• You are responsible for maintaining the confidentiality of your account credentials
• You agree to use our services only for lawful purposes
• You will not misuse, interfere with, or attempt to gain unauthorized access to our systems

5. Acceptable Use Policy

You agree NOT to use our services for:

• Submitting our work directly as your own without proper attribution
• Any activity that violates academic integrity policies or honor codes
• Plagiarism or academic dishonesty
• Reselling, redistributing, or sharing our work with third parties
• Any illegal purpose or in violation of any laws
• Harassment, abuse, or harm to others
• Circumventing or manipulating our systems or processes

Violation of this Acceptable Use Policy may result in immediate termination of services without refund.

6. Payment Terms

• All fees are due at the time of service agreement
• Payment must be completed before work commences
• Accepted payment methods will be communicated during the order process

7. No Refund Policy

IMPORTANT: ALL SALES ARE FINAL

• No refunds will be issued once payment has been made and work has commenced
• Once you have approved the project scope and made payment, you acknowledge that services will be rendered and no refund will be provided
• Partial completion does not entitle you to a partial refund
• Dissatisfaction with the final deliverable does not constitute grounds for a refund
• We reserve the right to offer revisions as specified in your service agreement, but refunds will not be issued
• By making payment, you explicitly agree to this no refund policy

Exceptions

Refunds may only be considered in the following circumstances:

• Services were not delivered due to our failure to perform
• Duplicate charges made in error
• Technical error resulting in overcharge

All refund requests must be submitted in writing within 48 hours of payment.

8. Intellectual Property and Copyright

• You retain ownership of any original materials you provide to us
• Upon full payment and successful delivery, you receive a non-exclusive license to use the completed work product for reference and educational purposes
• All work remains the intellectual property of Oxglow Analytics until full payment is received
• You may not resell, redistribute, or commercially exploit our work
• We reserve the right to use anonymized project data for portfolio, marketing, or quality improvement purposes
• You grant us permission to retain copies of your project for our records and quality assurance

9. Disclaimer of Warranties

ALL SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND.

• We make no guarantees regarding specific grades, scores, acceptance, or outcomes
• We do not warrant that our services will meet your specific institutional requirements
• We do not guarantee uninterrupted or error-free service
• We expressly disclaim all warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• While we strive for quality, we make no representations about the accuracy, reliability, completeness, or timeliness of our services
• Any material downloaded or obtained through our services is done at your own discretion and risk

10. Indemnification

You agree to indemnify, defend, and hold harmless Oxglow Analytics, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of our services
• Your violation of these Terms of Service
• Your violation of any third-party rights, including academic integrity policies
• Any academic misconduct or disciplinary action resulting from your use of our services
• Any dispute between you and any third party

This indemnification obligation will survive termination of these Terms of Service.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Oxglow Analytics shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services, including but not limited to:

• Loss of profits, data, or goodwill
• Academic consequences, disciplinary actions, or institutional sanctions
• Failure to achieve desired grades or outcomes
• Service interruptions or delays
• Errors or omissions in our work
• Any damages arising from your misuse of our services

Our total liability to you for all claims arising from or relating to these Terms or our services shall not exceed the amount you paid us for the specific service giving rise to the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

12. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:

• Acts of God, natural disasters, epidemics, or pandemics
• War, terrorism, civil unrest, or government actions
• Internet or telecommunications failures
• Power outages or equipment failures
• Labor disputes or strikes
• Supplier or vendor failures

In such events, our performance obligations will be suspended for the duration of the force majeure event.

13. Dispute Resolution and Arbitration

Informal Resolution

Before filing any formal dispute, you agree to contact us at thesis@oxglow.org to attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration

If informal resolution fails, you agree that any dispute arising from these Terms or our services shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if they qualify.

• Arbitration will be conducted by a neutral arbitrator
• The arbitrator's decision will be final and binding
• You waive your right to a jury trial
• You waive your right to participate in a class action lawsuit or class-wide arbitration

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Ghana, without regard to conflict of law provisions. Any arbitration or legal proceedings shall be conducted in Ghana.

14. Confidentiality

We respect your privacy and will not share your personal information or project details with third parties except as required by law.

15. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes constitutes acceptance of the modified terms.

16. Termination

We reserve the right to suspend or terminate your access to our services at any time for violation of these terms, without notice and without refund.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining terms remain in full force and effect.

18. Entire Agreement

These Terms of Service constitute the entire agreement between you and Oxglow Analytics regarding our services and supersede all prior agreements and understandings.

19. Electronic Consent and Agreement

By clicking "I Agree," making a payment, or using our services, you:

• Acknowledge that you have read and understood these Terms of Service
• Agree to be legally bound by these Terms
• Confirm that you are at least 18 years of age or have parental consent
• Understand the Academic Integrity and Proper Use provisions
• Accept the No Refund Policy
• Agree to the Dispute Resolution and Arbitration provisions
• Consent to electronic communications from us

This electronic agreement has the same legal effect as a signed written agreement.
